These Terms

Australian Health & Nutrition Association Limited trading as Sanitarium Health Food Company (Sanitarium) owns and operates this website. These terms apply to your use of the website, any product purchase and any product review. You agree to be bound by these terms.

If you do not agree to these terms, please do not use this website.

We may need to amend these terms without notice and recommend you check back in here to review these terms regularly. If any terms are found to be unenforceable, you agree that the rest remain in full force and effect.

PURCHASE TERMS

Account registration

To purchase our products you may decide to set up an account and be logged in using a valid email address. You are responsible for ensuring that your account details are accurate and up to date, and for keeping your account details and password confidential.

Orders

You can place an order by following our website prompts. We only accept orders from Australia. We reserve the right to accept or reject your order for any reason, including if the requested product is not available, there is an error in the price or product description on this website or an error in your order. Each order that we accept results in a separate binding agreement between us for the supply of that product on these Terms. If we reject an order placed through the Website, we will endeavour to notify you of that rejection as soon as possible.

Payment

  • All prices are in Australian dollars and are inclusive of any applicable goods and services tax.
  • We accept payment via debit or credit card (Visa or Mastercard).
  • You will be charged during the purchasing process and prior to delivery. If we are unable to charge your credit or debit card due to insufficient funds or other errors your order will be cancelled.

Delivery

  • We will deliver products via Australia Post or another carrier to the Australian delivery address you have nominated in your order.
  • Once your order is dispatched, it is not possible to change your nominated delivery address.
  • You will receive a tracking number via email once your order has been dispatched. If you are not home to receive your order it will be taken to the nearest Post Office for safekeeping and you will need to collect it.
  • Delivery times may vary depending on the carrier and delivery address. We recommend allowing at least 7 business days for delivery.
  • Delivery fees will be communicated to you before you place your order and must be paid at the same time and in the same manner as you pay for your order.
  • Risk in products passes to you on the date and time of delivery to the delivery address nominated in your order.
  • You warrant that the person receiving products at your nominated delivery address is authorised by you to do so.

Changing or cancelling orders

Once you have placed an order it is not possible to change or cancel the order or your payment method. This is because of the timeframe in which your order is picked and packed for delivery.

Out of stocks and substitution

If you place an order for a product that is out of stock or unavailable, we will endeavour to notify you as soon as possible and arrange either a refund or supply of a substitute product.

You have 30 days from the date of purchase to claim a refund of from your first order from pb nutrition.

To lodge a claim, please send us an email with your proof of purchase to CustomerRelations@sanitarium.com.au or call us on 1800 673 392 and our Customer Service team will provide you with instructions to help you make a claim.

Please ensure you keep hold of the product and follow our team’s instructions to submit the claim and post the physical product(s) in original product packaging back to us within of being provided your Return number.

You are responsible for all postage and costs associated with returning the product. We are not responsible for any misplaced or undelivered returns and recommend you use delivery confirmation methods when shipping.

Refunds will be credited to the card used to purchase the product. While we will promptly action eligible refunds, please note that it may take 30 days or more in processing time depending on your financial institution.

Incomplete, indecipherable or illegible claims will not be valid. If you have not complied with these Terms or if, in our opinion, you are trying to obtain benefits you are not reasonably entitled to, your claim will not be accepted. We reserve the right to change these terms or discontinue our 30 Day Money Back Guarantee offer at any time. Our 30 Day Money Back Guarantee is in addition to, and does not replace or limit your statutory rights including under the Australian Consumer Law.

Returns and refunds

Please choose carefully as, subject to the 30 Day Money Back Guarantee terms above, we do not offer refunds or returns for change of mind, personal preference or incorrectly purchased products.

If you receive a damaged product, you can make a claim for a refund or replacement. To lodge a claim, please send us an email with a clear photo of the damaged product to CustomerRelations@sanitarium.com.au or call us on 1800 673 392. Please ensure that you keep hold of any damaged products until we advise that they can be discarded.

Our products come with guarantees that cannot be excluded, restricted or modified under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law if we breach a consumer guarantee.

Personal use only

You may only use the Website for personal purposes unless we provide written consent otherwise. You are not permitted to purchase any of our products for resale to a third party for retail, wholesale or trade purposes without our prior written consent.

Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded, restricted or modified under the Australian Consumer Law. For major failures with a good, you are entitled to choose a refund or replacement. If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund of the price paid for the goods and to cancel any contract for the service and obtain a refund of any unused portion. You are also entitled to compensation for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Liability

Without excluding, restricting or modifying any rights and remedies you may be entitled to under the consumer guarantee provisions of the Australian Consumer Law, you acknowledge and agree that we are not liable for any loss or damage (whether direct, indirect, special, punitive, incidental, consequential or otherwise) arising out of or in connection with these Terms in contract, tort, under statute or otherwise, unless such loss or damage is caused by our own negligence, willful misconduct or fraud. Our liability to you for any loss or damage of any kind arising out of these Terms (whether in contract, tort (including negligence), under statute or otherwise) is reduced to the extent that you cause or contribute to the loss or damage.
